📜 Consignor Agreement

1.     Consignor Earnings

·        Consignors will receive 50% of the selling price of their items, less buyer fees and sales tax.

2.     Payment Collection

·        Payments may be collected in person within one year of the item’s sale date.

·        Payments are issued as cash or check.

·        Funds not collected within one year will automatically convert to store credit, redeemable in-store only.

·        Consignors may view sold items and balances through the Consignor Portal. Username and password are the consignor’s full email address (password may be changed after first login).

3.     Item Display & Sale

·        Accepted items will be displayed in-store and online for a minimum of 8 weeks.

·        All items will be priced at the discretion of OOTB INC.

·        Buyer fees apply and are paid by the customer, not the consignor.

·        Unsold items may be picked up on or before the expiration date provided at drop-off.

·        Items not collected by the expiration date become store-owned property and will not be returned.

4.     Item Condition

·        Items must be gently used, clean, odor-free, and less than 3 years old.

·        Items not meeting these standards may be declined.

5.     Buy-Out-Right & Drop-Off Guidelines

·        Buy-Out-Right: Mondays & Thursdays, 11 AM – 3 PM (no appointment required.

·        Consignment Drop-Off: Monday - Thursday: 11 AM – 6 PM (no appointment required)

·        Consignment Drop & Run: Friday & Saturday: 11 AM – 6 PM (no appointment required)

·        "No Thank You” items from Drop and Run will be donated without notice. No holds.

6.     Item Selection

·        OOTB INC. selects items based on customer demand, quality, and current inventory needs.

·        Acceptance is not guaranteed

·        The goal is mutual success for both consignor and store.

7.     Membership Fee

·        Each consignor pays a $5 annual membership fee.

·        Renewal fees are automatically deducted from the consignor’s account.

8.  Donations

·        Unsold or unclaimed items may be donated to local charities, including the Winston-Salem Rescue Mission, at OOTB INC. discretion.

9.  Damaged Items

·        Items later found to have damage (holes, tears, stains, broken zippers, chips, etc.) may be marked down or donated without notification.

10.  Safeguarding Items

·        OOTB INC. will make every reasonable effort to safeguard consignor merchandise.

·        OOTB INC. is not responsible for loss resulting from Fire, Theft, or Damage while items are in our possession.

11.  Buyer Fees

·        A buyer’s fee is added to each item to cover operational costs.

·        This fee is paid by the buyer, not the consignor.

12.  Uncollected Payments

·        Payments not collected within 12 months of the sale date convert to store credit with no cash value.

·        Store credit may be used in-store only.

13.  Sales & Promotions

·        All consigned items may be included in sales, promotions, and special events at OOTB INC. discretion.

14.  Agreement Updates

·        OOTB INC, D.B.A. Out of the Box Consignment, reserves the right to modify or update this agreement at any time without prior notice.
